- Business Day: Monday through Friday, excluding public holidays observed in Australia.
2. Eligibility and Account Registration
- Eligibility: You must be at least 18 years old and legally capable of entering into a binding contract to use Lexpro Exchange. By creating an account, you represent that you meet these requirements. Our services are intended for users residing in or sending money from Australia. Other restrictions may apply based on the country of the recipient or other legal considerations.
- Account Creation: To send money, you need to create an account with Lexpro Exchange. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. This includes your personal details and contact information.
- Identity Verification: As a regulated service, we are required to verify your identity. You agree to provide the necessary documents and information (such as identification and proof of address) upon request. We may use third-party services (like ID Fox) to assist with verification. If we cannot verify your identity to our satisfaction, we reserve the right to refuse or limit your use of the Service.
- Account Security: You are responsible for maintaining the confidentiality of your account login credentials. Do not share your password with others. If you suspect any unauthorized access to your account, you must notify us immediately. Lexpro Exchange is not liable for any loss or damage arising from unauthorized use of your account if you fail to keep your credentials secure.
3. Description of Service
Lexpro Exchange enables users to send money to recipients in various countries. When you submit a transfer request, we will execute the transaction by converting your funds to the requested currency and paying out to your designated recipient through our network of banking and payout partners.
- We do not offer accounts for the purpose of storing funds; any money you send us is processed for remittance to a recipient, not kept as a deposit.
- We do not facilitate cryptocurrency transfers or trades. All transfers are carried out in official fiat currencies.
- The Service is for legitimate money transfers only. By using Lexpro Exchange, you agree that you will not use the Service for any unlawful purposes (such as fraud, money laundering, or sending/receiving proceeds of crime).
4. Fees and Exchange Rates
- Fees: We will disclose the fee for each transaction upfront before you confirm the transfer. The fee may vary depending on the amount, destination, and payout method. By confirming a transaction, you agree to pay the stated fee. All fees are deducted from the amount you send or added to the amount you pay, as disclosed in the transaction summary.
- Exchange Rates: If your transfer involves currency conversion, the exchange rate will be provided to you at the time of transaction creation. This rate is locked in once you fund the transaction (subject to timely payment). We source competitive exchange rates based on market conditions. Note that exchange rates fluctuate, and the rate offered might differ from rates publicly listed due to our margin and market movements.
- Total Cost: The total amount you pay will consist of the transfer amount plus any fees (if fees are not taken from the sent amount). We strive to be transparent; there are no hidden charges from our side. However, please be aware that in some cases, intermediary banks or the recipient’s bank might charge their own fees (for example, a receiving bank fee if delivering to a bank account). Lexpro Exchange has no control over third-party bank fees.
- Changes and Promotions: We reserve the right to change our fee structure or exchange rate margin in the future. Any changes will not affect transactions that have already been confirmed by you. We may also offer promotions or discounts occasionally; such offers will be subject to additional terms.
5. Sending a Transfer (Transaction Process)
- Funding Your Transfer: After creating a transfer request, you must pay us the amount you wish to send (plus any applicable fees). Payment must be made using the methods we support (e.g., bank transfer from your account to our account, or other methods as we introduce them). Instructions for payment will be provided. If we do not receive your funds within a reasonable time (typically 1-2 business days), the exchange rate locked for your transaction may expire and the transaction could be canceled or subject to a revised rate.
- Cancellation: You may request to cancel a transaction before it is paid out to the recipient. If you need to cancel, contact us as soon as possible. If the funds have not yet been disbursed to the recipient, we will generally honor the cancellation and refund your money, minus any fees or costs that may have been incurred (for example, if currency was already converted, you may receive the refund in your original currency at the current rate, which could result in a difference in amount).
- Delivery to Recipient: Delivery times are estimates and not guaranteed, although we make every effort to meet them. We are not responsible for delays caused by external factors, such as banking holidays, delays in the banking system, inaccurate information provided, or additional compliance reviews. The recipient may be required to show identification or provide information to receive funds (especially for cash pickups).
- Notification: We will send you a confirmation when your transfer is completed. It is your responsibility to inform the recipient of the transfer if needed and to provide correct contact details for them if our partner needs to notify them (for example, for cash pickup, the recipient might get a message or call).
- Transaction Limits: We may impose limits on the amount you can send per transaction, per day, or over a certain period, as required by law or our risk policies. These limits can vary based on your verification status and the destination of funds. We will inform you if any proposed transaction exceeds our limits.
6. Compliance and Due Diligence
- We are obligated to comply with AML/CTF laws. This means we will monitor transactions and report certain activities to regulators. We might ask you for additional information about a specific transfer (e.g., the source of funds or the purpose of the transaction) to ensure it’s compliant with our legal duties.
- You agree to cooperate with any requests from us for further KYC documents or information, both at signup and during the course of the business relationship. Failure to provide information or if we suspect fraudulent or illegal activity can result in us refusing, delaying, or canceling your transactions.
- We reserve the right to refuse to process, or to cancel or suspend any transaction if we believe it violates these Terms or any law or regulation. This includes transactions that involve sanctioned countries or persons, or that appear to relate to unlawful activities. In some cases, we might not be able to disclose to you the reasons for such actions due to legal constraints.
7. Prohibited Activities
You agree NOT to use Lexpro Exchange or our services for any of the following:
- Illegal Purposes: Engaging in or facilitating any criminal activity, including money laundering, terrorism financing, fraud, tax evasion, or trading in illegal goods/services.
- Sending/Receiving on Behalf of Others: Using your account to send money on behalf of a third party who is not the stated sender or structuring transactions to avoid identification. Your account is for your personal/business use only as registered.
- Violation of Sanctions: Sending money to individuals, entities, or countries that are subject to Australian or international economic sanctions, where such transaction would violate sanction laws.
- Gambling Payments: Using the service to pay for gambling activities, unless explicitly permitted by us and legal in both the sender’s and recipient’s jurisdictions.
- Fraudulent Activity: Attempting to defraud us or any user, such as by providing false information, impersonating someone, or using stolen payment information.
- Interference with Service: Engaging in any activity that could disrupt or interfere with the functioning of our website or services, including uploading viruses or other malicious code.
If we suspect that you have violated any of the above, we may take action including freezing funds, terminating your account, reporting to law enforcement, and pursuing legal remedies.
8. Intellectual Property
All content on the Lexpro Exchange website and communications, including text, graphics, logos, and software, is the intellectual property of Lexpro Exchange or its licensors. You are granted a limited, revocable license to access and use the site for its intended purpose (sending money or learning about our services). You may not reproduce, modify, distribute, or create derivative works from our content without our explicit written permission. The Lexpro Exchange name and logo are our trademarks; you may not use them in any unauthorized manner.
9. Limitation of Liability
- Service Limitations: While we strive to provide excellent service, Lexpro Exchange does not guarantee that transfers will always be delivered within expected time frames or that the service will be free from errors or interruptions. We provide the service on an “as is” and “as available” basis.
- No Liability for Certain Delays or Failures: We are not liable for any delays, failures, or losses in transmission of funds due to circumstances beyond our reasonable control. This includes natural disasters, wars, strikes, network outages, or failures of our partners (like banks or payout agents). We will, however, make reasonable efforts to resolve any such issues that arise.
- Indirect Damages: To the maximum extent permitted by law, Lexpro Exchange will not be responsible for any indirect, consequential, incidental, or punitive damages resulting from your use of (or inability to use) our services. For example, we are not liable for loss of profits, loss of business opportunity, or any harm to your reputation arising from a delayed or canceled transfer.
- Maximum Liability: In all cases, our total liability to you for any claim arising out of or relating to our service is limited to the amount of the transfer in question (including fees), or AUD $1000, whichever is lesser. This limitation applies whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory.
10. Dispute Resolution
- Customer Service: If you have a dispute or issue with our service, first contact our customer support. Most concerns can be resolved quickly through our support team.
- Complaints: We have a formal internal complaints process. Upon receiving a complaint, we will acknowledge it and investigate. We aim to provide a resolution or response within a reasonable time frame (typically within 21 days).
- AFCA: Lexpro Exchange is a member of the Australian Financial Complaints Authority (AFCA), a free and independent external dispute resolution scheme chubb.com. If you are not satisfied with our resolution of your complaint, you may escalate the matter to AFCA. AFCA can be contacted at [contact details], and its services are free to consumers.
- Governing Law: These Terms and any disputes will be governed by the laws of the State of New South Wales and the federal laws of Australia, without regard to conflicts of law principles. By using our service, you consent to the jurisdiction of the courts in New South Wales for any legal action or proceeding arising out of these Terms or your use of the service, subject to the above requirement to use AFCA or other alternative dispute resolution processes for certain disputes.
11. Termination
- By You: You can stop using our services at any time. If you wish to close your account, you should contact us. Note that even after account closure, these Terms (and our Privacy Policy) will continue to apply to any past usage and we may retain information as described in our Privacy Policy.
- By Us: We reserve the right to suspend or terminate your access to Lexpro Exchange services at any time, with or without notice, for reasons including but not limited to: violation of these Terms, suspicious account activity, failure to pay amounts due, or as required by law enforcement or regulators.
- Effect of Termination: If your account is terminated (by you or us), any pending transactions that are not completed will typically be canceled and funds in transit returned to the sender (unless prohibited by law or frozen due to suspicion of illegality). Sections of these Terms which by their nature should survive termination (such as Limitation of Liability, Dispute Resolution, and Governing Law) will continue to remain in effect.
12. Changes to Terms
Lexpro Exchange may amend these Terms and Conditions from time to time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the change becoming effective. The latest version of the Terms will always be available on our website. By continuing to use the service after changes take effect, you agree to the revised Terms. If you do not agree with the updates, you must stop using the service.
13. Miscellaneous
- Entire Agreement: These Terms, along with our Privacy Policy and any other legal notices or terms expressly incorporated, constitute the entire agreement between you and Lexpro Exchange regarding our services. They supersede any prior agreements or communications.
- No Waiver: If we fail to enforce any provision of these Terms, it will not be considered a waiver of our rights. Any waiver of rights or provisions will only be effective if in writing and signed by us.
